By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Shipping times may vary according to availability and any guarantees or representations made as to delivery times are limited to the USA and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with New York Reef Aquatic, you must be 18 years of age or over and possess a valid credit or debit card issued by a bank acceptable to us. New York Reef Aquatic retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be New York Reef Aquatic or may in some cases be a third party. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

 

 

Our Contract

When you place an order, you will receive an acknowledgement email confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until you receive either one of the following:

  • Shipping/tracking number from shipping courier (ie: FedEx) indicating dispatch for the order designated to your listed shipping address or an address requested, confirmed and agreed by both parties via email correspondence.
  • Email from New York Reef Aquatic with provided confirmation that your order has been scheduled and dispatched by the courier along with its tracking number for your package.

Only those goods listed in the confirmation email sent at the time of order placed will be included in the contract formed.

 

 

Pricing and Availability

While we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Shipping costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

 

 

Payment

Upon receiving your order we carry out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorization check has been completed. Your card will be debited once the order has been accepted.

 

 

Discount Codes

Account discount codes - Discount codes may from time to time be offered to account holders; such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered.

 

 

These Terms and Conditions relate to all New York Reef Aquatic promotions, competitions and discount codes (unless otherwise stated).

 

 

  • Only one promotion code can be used per order

 

  • Selected brand exclusions may apply

 

  • A promotion code can't be used after an order has been placed

 

 

Gift Certificates

  • Gift Certificates are only valid for a limited time and the certificate must be used by the date shown on the certificate.

We can’t accept any responsibility for stolen or deleted gift certificates.

  • We’ll send your gift certificate either as soon as payment has been cleared or on your specified delivery date (if this is later). We can’t be responsible for any delays, no matter how they are caused.

 

  • If you are the purchaser, please double check the delivery email address you enter. It is your responsibility to do so. We cannot be held responsible if a gift certificate is used by someone other than your recipient if the email address entered is incorrect. In addition, we cannot take responsibility for any gift certificates that are lost or used by someone other than your recipient after delivery. Make sure your recipient has received their gift certificate, as it is their responsibility to keep the voucher details safe.

 

  • From time to time, gift certificate may get caught in spam filters, and it’s up to the recipient to check these filters. We cannot take responsibility if a gift certificate cannot be delivered to the recipient’s email address because of spam filters, firewalls, the capacity of the recipient’s mailbox or any other factors outside of our control.

 

  • If you need a refund, this will be made in the same way as the original payment method (such as onto a gift voucher, debit/credit card account, or a combination of the two).

 

  • We reserve the right to vary these terms and conditions.


The conditions of use relating to any discount code will be specified at the time of issue.

 

RETURNS AND CLAIMS

FISH & CORAL
No returns or refunds. Store credit only for DOA.

DOA Guarantee:
  • Please read 'Terms and Conditions' carefully.
  • Please do not discard specimens without our consent as this will void our guarantee.
  • If your deceased animal goes 'missing' or gets 'eaten', we will not provide a refund. Many missing animals are hiding and are not deceased. It is your responsibility to provide proof of the deceased specimen.
  • Customer must sign for package on the first delivery attempt -- even if FedEx or UPS is late.
  • If your order is delayed you are still required to receive it and acclimate all contents before contacting us. Delayed orders will be handled on a customer to customer basis.
  • Customer must follow all acclimating procedures even if animals appear dead. While we pack with the utmost care, fish or corals may be stressed from shipping and will become more lively after acclimation and rest.
  • Tank’s water chemistry must be within the following parameters: - Temperature – between 75°- 83° F and constant - Ammonia – 0.0 ppm - Nitrite – 0.0 ppm - Nitrate – 0.0-30 ppm - pH – 8.1-8.4 - Specific gravity – 1.020-1.025
  • We will not be responsible for livestock that has died as a result of being harassed or picked on by other fish.
  • Important - All live items are shipped by Fedex through Priority Overnight Service, Monday, Wednesday and Thursday and usually arrive by 10:30am EST or any time frame shown in the first. Please be informed that New York Reef Aquatic will not responsible for any delay by courier, weather, natural disaster or late pick up / recevive by customer. Certain remote areas are delivered later in the day. We use specific packing means necessary to ensure the safe arrival of your live coral. In the unlikely event of a DOA (Dead on Arrival), you must send a very clear digital photo within 2 hours of delivery (Fed-Ex posted time). We may ask for you to ship back the deceased animal, so please do not dispose of it. Once we receive the digital photo, and we receive the deceased coral (if applicable), we will issue a store credit. The store credit does not include the cost of shipping. We do not offer refunds, we only give credit toward future orders. You can use on www.newyorkreefaquatic.com
  • We cannot be held responsible for mechanical or weather delays that may cause your Fedex shipment to arrive late. We can hold corals for up to one week once payment has been received, unless other arrangements are agreed upon. Beyond that, we are not responsible for the coral, and cannot guarantee replacement of the same coral purchased. We are not responsible for incorrect addresses provided by the buyer.

Arrive Alive Guarantee:

  • We guarantee that all livestock will arrive alive and as described. In the event of DOA (Dead On Arrival) we must be contacted within 2 hours of package delivery (Fed-Ex posted time), along with clear photos of the dead coral both in the shipping bag and out of bag. BUYER MUST RECEIVE ITEM ON FIRST DELIVERY ATTEMPT. No exceptions or excuses, no credit without photo. No refunds or returns on Live purchases. Verified DOA's will be fully credited towards future purchases (minus any shipping charges). Once the livestock is in your tank, we have no control over the conditions, so no warranty is implied past delivery. If free shipping was applied to the order we will deduct all shipping costs from credit



How to submit a livestock claim:

  • Please reply directly from your Order Confirmation email with the stated terms of DOA required information stated above. A representative will reply as soon as possible with confirmation of approval or rejection of claim given a thorough review. New York Reef Aquatic reserves all rights to Approve or Deny claims subject to proof and terms provided. 
  • We will not issue any refunds but will issue a store credit with a picture of the deceased submitted via email.
  • We will not re-ship lost items, they will be credited instead and you may submit another order at a future date.
  • You will receive a confirmation email to let you know your account has been credited.
  • Sorry, we DO NOT issue credit or refunds for any shipping costs.
